A federal jury in Arizona reportedly found for Becton Dickinson & Co. (NYSE:BDX) subsidiary C.R. Bard today in a bellwether product liability case brought over its inferior vena cava filters.
Although it’s the fourth bellwether case in the multi-district litigation over the IVC devices, which are designed to prevent blood clots from passing through the body’s largest vein into the heart and lungs, Hyde v. Bard is the third case to make trial after its predecessor case was dismissed after the statute of limitations expired on the claims.
In the first case to go to trial, a federal jury in Phoenix found for plaintiff Sherr-Una Booker, awarding $3.6 million in damages. Bard prevailed in the second trial after the jury found that it properly warned of the potential complications and risks associated with the IVC filters. After the third bellwether was dismissed, Hyde v. Bard went to trial last month (earlier this week the judge hearing the case pared some of its claims).
Today, after a 12-day trial that ended Oct. 3, the jury found for Bard, Law 360 reported.
