5. FDA labels Physio-Control’s Lifepak 1000 recall as Class I
The FDA today labeled a select recall of Physio-Control Lifepak 1000 defibrillators over electrical issues as Class I.
A Class 1 indication from the federal watchdog indicates “a reasonable probability that use of these products will cause serious adverse health consequences or death,” according to the agency. Read more
4. Bard logs win in long-running stent graft patent spat with Gore
A Delaware federal jury awarded a win to C.R. Bard in an ongoing spat with W.L. Gore & Associates over ultra thin stent graft patents.
The 8-man jury ruled that Bard’s patent does not infringe on Gore’s patent, and that Gore’s patent is invalid, according to court documents released yesterday.. Read more
3. German court hands down another mixed decision in TAVR spat between Boston Scientific, Edwards Lifesciences
A German court issued a mixed decision in the international battle over transcatheter aortic valve replacement patents between Edwards Lifesciences and Boston Scientific, less than a week after a U.K. patent court handed down a similar TAVR decision.
Boston Scientific fired the 1st shot late last year in Germany with a lawsuit against Edwards, alleging that the next-generation Sapien 3 infringes claims covering the outer sealing skirt of Boston’s Lotus valve. Edwards claims that the Boston patent issued after Edwards launched the Sapien 3 valve in Europe and has leveled its own suits against its rival and subsidiary Sadra Medical; Boston Scientific filed counterclaims of its own in Germany and the U.K., where the Patents Court found 1 of its patents invalid but upheld another and ruled that Edwards infringes it. 2. Stryker levels another sales rep poaching lawsuit against Zimmer Biomet
Stryker yesterday leveled another lawsuit accusing Zimmer Biomet of poaching Stryker’s roster of sales reps, this time in Texas.
Stryker in 2013 sued a pair of former sales agents, accusing them of scheming to poach reps and business from Stryker in Louisiana and New York (that case is headed to a federal appeals court, after a jury in February 2016 found for Stryker and awarded $745,195 in damages). Read more
1. House Ways & Means passes Trumpcare bill
The House of Representatives Ways and Means Committee today approved the new “Trumpcare” healthcare legislation, backed by Republicans and Donald Trump, clearing its 1st hurdle to implementation.
The bill was passed along party lines this morning after nearly 18 hours of debate. The House Energy and Commerce committee have yet to approve the newly inked plan. Read more
