2. Ex-Biomet sales rep alleges retaliatory firing for blowing the whistle
A former sales representative for Biomet, now part of Zimmer Biomet, filed a lawsuit claiming his former employer fired him for blowing the whistle on an alleged kickbacks scheme.
The sales representative, Michael Swiss, filed the lawsuit Oct. 22 in New York Supreme Court in Ulster County, alleging violations of the anti-retaliation provision of the New York False Claims Act. Swiss is seeking $10 million in damages. Read more
1. Medtronic challenges Masimo patents
Medtronic challenged a pair of Masimo patents covering pulse oximetry technology, filing inter partes reviews with the U.S. Patent & Trademark Office.
The petitions allege that claims in 1 of the patents, covering “Signal processing apparatus,” are obvious due to prior art that the patent office “did not fully consider during prosecution as the prior art did not form the basis of a rejection.” Medtronic alleges obviousness and anticipation for the 2nd patent, according to documents filed with the PTO’s Patent Trial & Appeal Board.
